All Products sold through the Mr Brownie website are subject to these Terms & Conditions. By using this Website, whether as a guest or registered user, you confirm and affirm that you have read, understood and agreed to be bound by the Terms & Conditions in the form in which they appear at the time you are using the Website. Mr Brownie and its Management reserves the right to revise, amend, withdraw or make changes to these terms and conditions in part or in whole at any time with or without prior notice to its users. All revisions, amendments, withdrawals or changes shall be effective immediately once they are posted on the Site.

 

Indemnity

By using the Mr Brownie website, you agree to indemnify Noel & Whisky and its staff against any and all claims, demands, or liabilities (including any legal fees and cost) that are made by any third party due to or raising from your use of the site and/or your breach of the Terms & Conditions.

Mr Brownie will try our best to publish only accurate materials and information on the website. Should any materials and/or information found to be inaccurate, please inform our staff at 6536 8220 or email to orders@noelwhisky.com and we will gladly rectify it. Please be ensured that all misrepresentations are not done to deceive or cheat.

Mr Brownie will not be held liable for any harm, damage, injury or expense which may result from the products purchased or information posted on the Mr Brownie website.

 

 

Account Creation

The Customer must be over 18 years of age, and shall complete the registration process according to the requirements as stated on the Mr Brownie website.

He/she is required to provide personal information including name, current and valid e-mail address, billing address, delivery address (if different), and contact phone number. contact details and other information that is otherwise not publicly available during the registration of an account on the Website or in the course of using the Services.

The Customer warrants and certifies that the personal information he/she is required to provide is at all times true, accurate, current and complete. All personal information provided by customers will be stored safely and securely. The information provided will not be disclosed, sold, shared or rented to third parties or organizations for commercial purposes or any other purposes undisclosed within the Terms and & Conditions.

Mr Brownie reserves the right to cancel any unverified or inactive account or an account that is found to have inaccurate information, or if it is determined to be compromised or used for fraudulent purposes.

The Customer agrees to the use of his/her personal information for the purposes of Mr Brownie in providing its Services to him/her. Such use of personal information shall be in accordance with the Terms & Conditions. The Customer may not transfer his/her account or account login/password to any other person.

 

 

Security

The account password created by the Customer should be unique and kept secure. The Customer is entirely responsible for maintaining the confidentiality of the information provided when registering an account. The Customer agrees to limit the access of the account to himself/herself only, and take all reasonable measures to ensure the confidentiality of the account password used to access the Services.

As the account can only be accessed by the Customer, it is agreed that the Customer will be responsible for all activities that occur under the account. If the Customer becomes aware of or suspects any unauthorized use of the account or theft of password or account information, he/she should notify Mr Brownie immediately.

The Customer consents to disclose all personal information provided to all staffs of Mr Brownie including home delivery personnel, and consents to Mr Brownie use of such information provided for the purposes of his/her use of the Services.

 

 

Products

Your order is confirmed once you receive an order confirmation from us via email, which includes an order reference number. If, for whatever reason, we cannot process your order, we will call you on the phone number that you have provided during registration of an account.

If a product is Out of Stock, we will contact you to advise you on the expected waiting time and make necessary adjustments to the order. We would also be happy to make alternative recommendations of which price will be adjusted accordingly.

 

 

Delivery Information & Charges

Delivery is free for all orders above SGD$200 within Singapore. For order below SGD$200, $20/trip for normal delivery outside CBD and $30/trip for normal delivery within CBD will be charged. Urgent same day delivery will be charged at $50/trip subject to availability.

We deliver to all places in Singapore, including Sentosa. All packages are delivered by our own crew or by dispatch companies that we engage. We endeavour to have all orders dispatched within 3-5 working days from the day of order submission. Orders placed after 8am on Friday, Saturday and Sunday, will be processed on next Monday.

Delivery must be acknowledged by the Customer or his/her authorized recipient on Noel & Whisky delivery invoice. The Customer should ensure that an authorized recipient is present at the delivery address during the selected time slot to receive the delivery, failing which we reserve the right to charge a penalty fee of $30, regardless of whether re-delivery or self-collection is chosen. Self-collection is available at our warehouse located at 196 Pandan Loop #06-16 Pantech Business Hub S128384. Please contact our Delivery Service Officer at 6536 8220, 2 days in advance prior to collection.

Should any Product in the Customer’s order be unavailable for any reason, our Delivery Service Officer will contact the Customer to arrange for an alternate delivery timing or change of order.

Amendment / Cancellation of Order

No cancellation or amendments of order are allowed once order is confirmed at check out. We reserve the rights to accept or reject request for order cancellations/ amendments at our sole discretion.

Subject to the Customer's consent, should any products ordered by the Customer be unavailable, Mr Brownie may substitute it with another similar item. The final order amount charged to the Customer will be adjusted accordingly for any price difference. However, Mr Brownie reserves the right not to replace the unavailable Product and provide a refund instead.

No substitution will be made for unavailable products without prior consent from the Customer and a credit adjustment for the unavailable product will be made accordingly if the Customer rejects the substitution.

Mr Brownie reserves the right to not accept orders of any Product that may have been presented wrongly or inaccurately on the Website. The decision to honour any price discrepancy is solely at Mr Brownie’s discretion and its decision shall be final.

The prices reflected on the Website are subject to change at any time. However, the final cost of the Product(s) including all applicable delivery charges, taxes and duties is quoted before the Customer confirms his/her order. Once the Customer completes the online order, it is deemed that the Customer has acknowledged and fully accept the final price.

Exchange Policy

All products sold on Mr Brownie are warrant against manufacturing defects. Customers are strongly advised to check their items at the time of delivery to avoid any possible dispute. All Products leaving Mr Brownie’s warehouse have been checked for quality, quantity and sizing accuracy. However, we understand that Customers may not check some of the products on the spot upon receipt of the items, hence, we do allow for exchange on a case by case basis.

In the event that the items received is defective or incorrect, Mr Brownie will offer a 1-for-1 exchange. Customer must report to Mr Brownie at 6536 8220 or email to order@noelwhisky.com within 7 working days of delivery of the order and our Customer Service Officer will assist you in processing product exchange. The exchange is subjected to stocks availability. In the event that there are no available stocks, we will offer a credit refund instead.

Exchanges will only be allowed for incorrectly sized items, products with manufacturing defects and wrongly delivered items.

Customer must ensure that the products returned are safe and securely packed so as to ensure that the exchanged product(s) are not damaged and suitable for resale. Customer are also required to provide the original payment invoice or proof of purchase. We will deliver and exchange the items are no additional cost.

We reserve the right to reject goods for exchange should the products be damaged or not in re-saleable condition or if the Customer fails to provide proof of purchase. In the event that the exchanged item is no longer available, our Customer Service Officer will advise accordingly on suitable replace or refund you for the product.

 

Please note that the following items are strictly non-exchangeable or refundable:

Refund will be made to the Customer within 14 working days upon receipt and acceptance of defective products by our Customer Service Officer. If payment was made using Credit Card or PayPal, refund will be credited to your Credit Card or your PayPal account. If payment was made via Cash on Delivery, the refund will be made via cheque and mailed to you. If you hold a credit term with us, our Customer Service Officer will advise you accordingly.

Mr Brownie reserves the right to collect products that was delivered to the Customer by mistake and Customer shall be obliged to return such items that was not part of the order.

Mr Brownie shall not be further liable for any damage, loss or inconvenience suffered arising from any discrepancy of our merchandise.

 

Payment

Payment for purchases on this Website is to be made via Credit Card, PayPal, Cash on Delivery or Credit Term which will require payment after 7 or 30 days depending on the Credit Term provided. PayPal is a secure payment channel where the Customer’s financial data, such as credit card and account numbers, are not revealed to Mr Brownie. PayPal also employs SSL technologies and a series of security procedures to protect the Customer’s information and enable secure online shopping. By using PayPal, the Customer is also protected from any unauthorised transaction.

After the checkout process, PayPal will carry out a standard pre-authorization check on the Customer’s payment card to ensure that there are sufficient funds to fulfil the transaction. Products will not be dispatched until this pre-authorization check has been completed and payment has been received. The Customer’s card will then be debited. The Customer acknowledges that Mr Brownie has no control of or responsibility over PayPal or any other payment method, and hence cannot guarantee the service level of the payment method. To ensure proper payment, the Customer is solely responsible for providing and maintaining accurate contact and payment information associated with his/her account with Mr Brownie.

For Corporate Customers, you may email to XXX to apply for 7-day or 30-days credit term. We will review on a case by case basis. Corporate Customers holding credit terms are to make payment within 7 days or 30 days as applicable. Credit Terms are only available to corporate customers.

The Customer agrees to pay all applicable taxes or charges imposed by any government entity in connection with the purchase of goods and/or products. If taxes are required to be paid, Mr Brownie is entitled to invoice the Customer for such charges and all costs incurred by Mr Brownie in the processing of the order.

All prices in other currencies apart from Singapore Dollars (SGD) is provided as is. It will vary according to conversion rates as determined by the credit card company and Mr Brownie will not be liable for any discrepancy in prices due to conversion rates.

In the event of disputes with regards to pricing, products, or any other matter, Mr Brownie Management reserves the right to solve it at its own discretion. Mr Brownie reserves the right to amend, refuse, or cancel at any time, terms & conditions, promotions, notices and orders in the event of dispute or if we are unable to fulfil them.

No content, part of whole, on the site may be reused, distributed or modified in any form without prior permission. Mr Brownie is not responsible for any materials submitted by the Customers to the public areas of this website. Any or all materials submitted by Customers are not endorsed, reviewed or approved by Mr Brownie. Mr Brownie reserves the right to remove any material without prior notice if it is found that the contents of the uploads bear the following intention of:

 

1.       Defaming, abusing, harassing, threatening Mr Brownie’s staff, users or third parties
2.       Publishing, posting or distributing any defamatory, indecent or unlawful materials
3.       Publishing, posting or distributing materials containing marketing or promotional material and/or information intended to solicit business
4.       Posting or uploading files that contain virus, worms, key-loggers or any similar software or programs that may damage Noel & Whisky and/or any users or third party’s computer and/or network.

 

All non-personal information posted on the public areas of mrbrownie.com is on a non-confidential basis. Mr Brownie reserves the right to use, reproduce, edit or duplicate all such information freely for whatever uses.
